We Are Still s Constitutional Republic: A Short History of the Constitution

 I have tried over the years to educate people on the Constitution and what it means, what the Founders wanted, and how it is being perverted today. I do not go into this lightly. I have read the Constitution of the United States several times and refer back to it whenever I cite it. I have read the Federalist Papers and cite them at times. I have read the Federalist Farmer's letters responding to the Federalist Papers. I have read Madison's notes that he took while the debates were going on during the Constitutional Convention. I refer to all these documents when talking about how our government was set up, how it is supposed to be run, and how our government today is not using that so-important document as written and intended. Am I a Constitutional scholar? No. I am a high school graduate with very little education above that.

I was, actually, a licensed tax preparer in Oregon for about five years. In the great state of Oregon, to become a tax preparer it is a five week course on taxes and how to prepare them. After the course, it is a five hour test covering everything you need to know to prepare individual, small business, and corporate taxes. I passed that grueling test with 15 minutes to spare and had a grade of 89%. Not the brightest bulb in the box but smart enough to please the state of Oregon.

I don't pretend to know everything. I do make mistakes. I am a Constitutional originalist that believes it is a legal document set in stone. It is the Law of the Land. A judge does not 'interpret' the law on a whim or by the political ideas of the day. Over the last almost two and a half centuries politics have changed over and over again. One administration believes one thing and the next another. Slavery was alright when the country was founded. It isn't today. It took thousands of lives and a civil war to end that. Who was the champion? Abraham Lincoln, a Republican. The Thirteenth Amendment abolishing slavery was ratified on 6 December 1865.

Women couldn't vote until Rep. James R. Mann (R, IL) proposed to the House in favor of the Susan Anthony Amendment allowing women the right to vote on 21 May 1919. Overwhelmingly supported by the House, Congress passed the 19th Amendment on 4 June 1919 and the Women's Suffrage Amendment was certified on 26 August 1920.

At one point it was illegal to sell alcohol by Constitutional law. That law was revoked several years later by another amendment to the Constitution.

The winds of change never cease. To change the Supreme Law of the Land it takes a two-thirds majority in Congress and three-quarters of the States to ratify the change. The Founders didn't want to make it easy to change that document because they knew that politics changed dramatically over time and on a whim. They were not stupid by any stretch of anyone's imagination. They feared a strong central government; especially since they had just finished fighting a long war to free the colonies from just such a tyranny.

When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.” Declaration of Independence.

I put some of that text into bold because that is some of most important parts of the Declaration. Even before we became a free and independent nation the Founders knew that government should not be changed easily or by the winds of political climate. That is why I believe the Constitution is iron-clad, cast in stone and unchanging without a long, drawn out process to make sure that the changes being made aren't for 'light and transient causes.' Congress seems to think that the Constitution is nothing but a piece of parchment that is no longer necessary and, in some cases, a nuisance to their causes.

Presidents, at times, don't like the hindrances of the separation of powers and tend to legislate from the Oval Office through Executive Orders. Congress has used the Supreme Court to legislate that which wouldn't pass in open debate and voting in the Chambers. This is not what the Founders envisioned. Not even close. A small, weak central government with enumerated powers. All power not delegated to the Federal Government is in the hands of the individual states and, most importantly, The People of the United States.

I have listed the powers of the Government on previous blog posts so I won't do it here. Let it be said that we, the People, have been lax in our oversight of government. We have allowed the Federal Government to become bloated and all powerful. I've heard it said many, many times over my sixty-plus years: “You can't fight City Hall.” All I can say about that is; “Like Hell you can't! They work for us! Not the other way around.” Every single government employee is a direct employee of the citizens of this nation. It is our tax money that pays them. Our elected officials have only so long before it's time to re-elect them or kick them to the curb. For the non-elected employees, well, we still pay them.

There are laws that have been passed that we, the citizens, immigrants, visa-holders, and visitors to this country have to follow. We have law enforcement to uphold those laws. If you break them and get arrested, well, you won't get far by telling that sheriff, deputy, or beat cop that he's fired. It don't work like that. There are ways to make your voice be heard. Most of the time it's in a courtroom. Sometimes it's through grievances to the City Council. In the end, it is us, the citizens of the United States that hold the ultimate power. We, the People. Too bad that isn't taught in school anymore.

The school system is broken by an all-powerful government. We are forced to attend school and most times it is a government-run school. That being said, what are we taught? We are taught only what the government wants us to know. Civics isn't taught. Government isn't taught. The Constitution isn't taught. If they are, it's only in passing. It's much easier to take away things that you don't know you have. It's all written down on a piece of parchment that is 234 years old. Ratified on 21 June 1788, The Constitution of the United States of America is still the most important document in American history.

There were thirteen colonies that became the first states of the new nation. Now, 248 years later that number has grown to 50 states and several possessions (Puerto Rico, Guam, Northern Mariana Island, American Samoa, Palmyra Atoll, Howland Island, Johnston Atoll, Wake Island, and a few others). The country has grown since the Revolution of 1776 but, the Constitution has not and should not. The Founders knew that their new nation would not stay confined to the original thirteen but, they also knew that there needed to be a set way to govern no matter how big the country became. It's all in there. In black and white.

In today's world if you aren't 'woke' then you are some kind of racist, misogynist, xenophobe, homophobe, transphobe, or a host of other -phobes. People don't know if they are a boy or a girl and want to be called 'they/them.' Boys are competing against girls in sports because they can't win against other boys. Men pretend to be women for reasons that are most time nefarious. Racism has made a comeback that makes the race riots of the 1950's and 1960's look like a trip to Disneyland. Major corporations are condoning and even helping indoctrinate our children into the gay/trans world whether they like it or not. Schools are perpetrating trans agenda upon any child that mentions that they don't feel like the sex they are. Critical Race Theory is being shoved down the throats of school children from a young age through college. Marxism and Socialism are being taught as the best political/economic system and Capitalism/Individual freedoms are being taught as racist and unfair.

Who is behind all this anti-America agenda? Who is forcing this ideology upon the people of the nation? Who is to blame? We, the People are to blame because we haven't stood up and asserted our God-given rights and authority over an elected government that shouldn't have the power that it does.

Please, for the sake of America, read the Declaration of Independence, the Constitution of the United States, the Federalist Papers, the Federalist Farmer, and Madison's notes. Read them till you understand just what it was that the Founding Fathers of this nation intended us to be. IF you do pick up a book that has these documents and you DO read them, please, read them carefully, intentionally, methodically, and with the idea that you were right there when they were being written for the first time. Pretend that you were involved in the debates over what should and shouldn't be in the Supreme Law of the Land. Pretend that you were standing alongside General George Washington overlooking his ragged troops, weary from fighting an almost impossible battle against an army that had never lost. Pretend that you were there when Lincoln gave his speech at Gettysburg.

Remember this, the 56 men that signed the Declaration of Independence vowed their fortunes, their honor, their very lives to a cause that became the Great Experiment – a country that was of the PEOPLE, by the PEOPLE, and for the PEOPLE. A Constitutional Republic with an elected government that would change on a regular basis. Not a democracy because democracies always fail. But a representative government. “We are the rightful masters of government.” A. Lincoln.

Communism in America Today

 Back in the good old days of the Cold War, you know, when the only thing we had to worry about was Russia bombing us with nukes or trying to take over our country with Communism, it was so easy. We had our little drills of sitting in the hallway in school with our heads between our knees so that when we got hit with a nuclear bomb we were ready.


Let's not forget the McCarthy investigations on all those commies in Hollywood, sports, and the government. You know, when all you had to do was be accused of having Communist connections and your life was over. A LOT of really good actors lost their livelihoods because of Senator McCarthy; People like Lew Ayres (Dr. Kildare). With all the endless investigations and hearing in Congress it was surprising that they got anything done in the form of governing. Yes, those were the days!


Speaking of commies, how did they attack our great nation back then? Do you really want to know? During the last half of the 1940's there was a radio show on called “I Was a Communist For the FBI” that starred Dana Andrews as undercover agent Matt Svetick. Mr. Svetick was undercover as a Communist for nine years trying to thwart the agenda of the Communist Party here in America. He risked his life every day to keep America free. The stories told on the radio show were from his files, true with only names, places, and dates changed for obvious reasons. By the way, there was also a movie of the same name that starred Frank Lovejoy.


Do you want to really know how the Communist Party worked here in America? Listen to the stories told and/or watch the movie. They are on YouTube. I will tell you this: one way they worked was to incite violent riots during peaceful protests, used our Constitutional rights as a way to push their tyrannical agenda, brainwashed good, patriotic Americans into believing their way was better than our capitalist way. They pitted people against each other by shouting inequality, racism, police brutality, etc.


Racial/economic division, inciting violent and destructive riots, brainwashing the citizens, turning citizens against each other; all are Communist ways to change the government. What does that have to do with what is going on in America today? Think about it, people! What is the far-left doing? Not ONE Democrat has denounced the very violent and destructive riots of the summer of 2020. Not ONE Democrat has denounced or investigated the storming of the White House. Not ONE Democrat has denounced or investigated the fire-bombing of the Federal Courthouse in Portland. Not ONE Democrat has done anything but investigate Donald J. Trump and his supporters.


Right now, with a so-called pandemic in full swing, what are the Democrats (and quite a few Republicans) most concerned with? Is it the wide-open borders with millions illegally crossing with approximately 25% COVID positive? Is it the rampant violence and crime in the major, Democrat-controlled, cities? Is it the rampant suicide and addiction rates across the country? Is it the human and drug trafficking across the border? No, it is the January 6, 2021 Trump rally, peaceful protest, and a handful of individuals that were allowed into the Capitol complex that broke some windows and sat in Nancy Pelosi's chair. There are still over 500 people incarcerated in Washington, DC that are not allowed bail, access to an attorney, or have even been charged with anything. Why? The answer is simple: they were at the Trump rally on January 6th.


The Communists of the 1940s and 50s ruled with an iron fist. They spied on their own members to make sure they were good, strong Communists. What are the Democrats doing within their own party? If you are a member of the Democrat (now known as the American Communist Party) Party, you do exactly as Nancy Pelosi says or you are ostracized, threatened, and/or humiliated. Nancy Pelosi would make Nikita Khrushchev very proud.

The Democrat Party, along with several Republicans, are working extremely hard to change our Constitution through legislation. They want to federalize elections, allow open voting with no way to prove citizenship, who actually voted, or even in the ballot is real or not. They have done nothing about the millions of illegals crossing the border, they have preached Critical Race Theory to our children, they have divided the country economically, racially, and politically. They are waging war against anyone that disagrees with them and/or supports conservatism and capitalism. They have used a man-made virus (paid in part by the United States taxpayer) released from a lab in Wuhan China to cause chaos and fear across the globe. They have taken rights away from the American citizen left and right because of the coronavirus. They are the most anti-American, anti-capitalist, anti-freedom party in the history of our nation. Bar none.


This is not the Democrat Party of even 40 years ago. Even the Clintons were not as anti-America as they are now. There has always been corruption in politics. The Democrat Party doesn't even try to hide it anymore. They just scream that if you don't agree with them you are a racist, you are trying to destroy our 'democracy,' and best of all, YOU ARE A DOMESTIC TERRORIST. Andrew McCabe said it: the biggest terrorist threat to America is the middle class, white, MAGA business owner.


I don't have the time to go into everything the Communists did 60 or 70 years ago to try to convert America to Communism. It would take a thousand page book. What I can do is tell you that the Democrat Party of the new millennium is doing exactly what Lenin, Marx, Stalin, Mussolini, Mao, Hitler, Chavez, etc., have done over the decades. Exactly! Do some research. I believe the people that read my posts actually have a brain and can think for themselves. I also believe that you can actually read, write, and understand English. Unlike the 'woke' crowd that can't even figure out what pronoun they are.


The far-left are destroying our nation. That is obvious. They are not being stopped by the Republicans in Congress. Who is to stop them? If our elected officials (who, by the way, are OUR EMPLOYEES) won't do what we want them to, who will? It is up the US, we, the PEOPLE, of the United States of America to stand up and protect our Constitutional Republic. It wasn't the entire population that wanted to be free from English rule. It was a handful of outlaws, traitors to the King, freedom loving Americans. Guess what? That handful of rebels beat the world's strongest army and gained the freedom that everyone deserves. It's time we fought that battle again, in any way possible, to keep that freedom. The one word that William Wallace could get out in Braveheart after being tortured was what? FREEDOM!

The Declaration of Independence and How It's Important Today

 

During the Federal Convention of 1787, the Founding Fathers, including but not limited to, George Washington, Thomas Jefferson, James Madison, and Alexander Hamilton, debated fiercely for, and against, the Constitution. They all believed that a centralized government was needed but that it should not be too powerful in its scope. Strong enough to keep the emerging nation alive and safe, yet weak enough as to not become a tyrannical, over-powerful force against the sovereignty of the several states that had just gained their freedom and liberty from just such a government.

The Declaration of Independence stated quite clearly the grievances against the rule of King George: We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. That whenever any form of government becomes destructive to these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness. But, when a long train of abuses and usurpations, pursing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security,

What, exactly, were the founders talking about? What did they mean by a ‘long train of abuses and usurpations?’ What ‘absolute despotism’ were they talking about? In 1776 they were talking about the law of England and the tyranny of King George when it came to the American colonies. They went so far as to list the King’s abuses. First was his refusal to assent to laws, the most wholesome and necessary for the public good. He forbid his governors to pass necessary and important laws until his assent was obtained, which it may, or may not, be granted. He refused to pass laws for the accommodation of large numbers of people unless those people relinquished the right of representation in the legislature.

The King called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public records. He refused, after such dissolutions, to cause others to be elected; whereby the legislative powers, incapable of annihilation, have returned to the people at large for their exercise; the state remaining in the meantime exposed to all the dangers of invasion from without, and convulsions from within. He obstructed the administration of justice, by refusing his assent to laws for establishing judiciary power. The made judges dependent on his will alone, for the tenure of their offices. He erected a multitude of new offices, and sent hither swarms of officers to harass our people. He effected to render the military independent of and superior to civil power.

He combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his assent to their acts of pretended legislation. He protected some by mock trial, from punishment for any murders which they should commit on the inhabitants of these states. He imposed taxes on us without our consent. He deprived us in many cases, of the benefits of trial by jury. He took away our charters, abolishing our most valuable laws, and altering fundamentally the forms of our governments. He suspended our own legislatures, and declaring themselves invested with power to legislate for us all cases whatsoever. He, at that time, was transporting large armies of foreign mercenaries to complete the works already begun with circumstances of cruelty and perfidy, scarcely paralleled in the most barbarous ages. He excited domestic insurrection amongst us, and endeavored to bring on the inhabitant of our frontiers, the merciless savages, whose known rule of warfare, was undistinguished destruction of all ages, sexes and conditions.

Finally, the Founders stated this: In every stage of these oppressions we have petitioned for redress in the most humble terms: our repeated petitions have been answered only by repeated injury. A prince, whose character is thus marked by every act which may define a tyrant, is unfit to be the ruler of a free people.

What does all that have to do with what is happening today in Washington, DC? Let’s go through this step by step, clause by clause.

The Founders said that the King refused his assent to wholesome and necessary laws. That means he wouldn’t agree to those laws. What is the SCROTUS doing right now? He is refusing to agree with any law that is PRO-American. He overturned everything that Donald Trump had done to make this country what it was – the greatest country in the world. He refuses to enact laws that keep us safe, such as border security, illegal migration, deporting known criminals, etc.

Biden is openly disagreeing with governors that try to enact laws beneficial to their states, and the security of the nation. Congressmen are openly disagreeing with those that are making sanctuary cities and states illegal, abortions illegal, and going against the federal government mandates for economic disaster and collapse.

When it comes to refusing to pass laws for large numbers of people unless they give up their representation; our elected officials don’t represent Americans anymore. Their actions, and the actions of the President and Vice President, clearly are aimed at illegals more than citizens. When illegals have more rights than citizens we are not represented.

Has Joe Biden called together legislative bodies at unusual places, uncomfortable, and distant? No more so than what it always has been. What he is doing, and the Congress is wanting to do, is to make the seat of the central government a sovereign state with representatives. This is not what the Founders intended for the seat of the Federal Government. This is what makes thing seem unusual.

Do I need to get into how the government refused others to be elected? The corruption and fraud of the 2020 election is what compares to this clause. Somehow, six states stopped counting votes at approximately the same time and seemed to come up with enough votes to turn the election in favor of Joseph Robinette Biden during that time period. Pennsylvania even went against its own Constitution to change election law so that the liberal left could win. Then, no one, not even the Supreme Court, would even look at any of the evidence, hundred of videos, thousands of eyewitness accounts and affidavits, all ignored until after the certification of the electoral vote.

This goes right into the judiciary clause of the Declaration. The Deep State and the Washington establishment, career politicians refused to let the judiciary look into the election integrity. The Federal Government, Deep State, Establishment, and career politicians have allowed obvious criminality amongst themselves, such as the Clinton email scandal, the Russian collusion hoax, the illegal use of the FISA Court, the lack of presumption of innocence of any Trump ally, etc. Then goes further and includes the next clause of judges being dependent on them for their livelihoods. The far-left has many judges in their back pockets, including some Supreme Court Justices.

What has SCROTUS done since being inaugurated? Here comes the next clause! He has established many, many new offices, unnecessary for governance, as is the wont of the Democrat Party. The bigger the government, the more control government has over the people.

The military is another thing. With the modernization of weapons and the cost incurred in producing those weapons, it is impossible for the people to be equally armed. What makes this clause important today is the militarization of law enforcement. Even with the outcry for defunding the police, the elitists, politicians, entertainment personalities, and sports stars all have military equipped security. They are protected against the people while the people are not allowed to protect themselves. The attacks on the Second Amendment prove that. The government wants to disarm the people so we cannot fight back if it comes to that.

How does the clause concerning combining with others to subject us to jurisdiction foreign to our constitution? Mr. Biden, and his administration, are focusing on foreign laws to legislate against the American people. They are using UN dictates as American law, even though those dictates are expressly against the Constitution of the United States.

The Democrat Party is the party of tax and spend. Mr. Biden has said, as did every other Democrat candidate, during the campaign, and now since he has been installed as the President, that he will definitely raise taxes to highs that are unaffordable to the working man. These taxes run from income tax to capital gain tax to property tax. Why is raising taxes so important? Someone has to pay for all the Democrats programs and policies whether they want to or not. The biggest insult here is not that they are spending Trillions of dollars on helping Americans, they are spending Trillions of dollars on foreign nations, Democrat donors, unnecessary pet projects, and themselves. Trillions of dollars in debt and they want to borrow more and more to spend more and more on unnecessary things while giving the American taxpayer pennies on the thousands of dollars.

The clauses of depriving us of trial by jury and transporting us to be tried for pretended offenses comes after the ‘insurrection’ of January 6, 2021. The people that have been arrested for the pretended insurrection have been transported to Washington, DC, not given bail, not provided with a public defender, and not being brought before a judge. The ‘insurrection’ of Jan 6 was a protest against an illegitimate, corrupt, and fraudulent election. Out of the thousands that attended the Trump rally and walked to the Capitol Complex, there were about 120 people that breached the Capitol building and did damage. The majority, by far, was peaceful, respectful, unarmed, and still targeted by the far-left as criminals.

Another example of the present administration, the Deep State, Washington establishment, and the far-left depriving an American citizen of due process is what is happening with Donald Trump and his allies. Democrat Attorneys General, Democrat judges, Democrat Federal prosecutors are targeting Trump and his allies for anything they can. They have been on fishing expeditions since Trump announced his candidacy in Trump Tower back in 2015. They have targeted military leaders, such as General Mike Flynn, former Mayor Rudy Giuliani, Trump aides, such as Carter Page and George Papadopoulos, they even put Paul Manafort into solitary confinement to try to get him to betray Donald Trump. These people, and others, had their homes and offices raided and ransacked, personal papers confiscated, were arrested, interrogated, charged. All because they support Donald J Trump. Yet people like James Comey, Hillary Clinton, Barry Soetoro, Peter Strokz,  and a host of other high level, prominent Democrats with overwhelming evidence against them go free.

How is the Federal government taking away our charters, abolishing our laws, and altering fundamentally the forms of our governments? Do you really need to ask that? With the government inviting millions of illegals into our country, transporting them wherever they want to go, not demanding they return to their home country to apply for asylum (mainly because 99% aren’t eligible for asylum) the government is fundamentally changing the dynamic of our voter rolls. Our laws don’t mean anything to the illegals. If they did, they would be deported immediately or jailed. Only in a Democrat controlled America can you come into the country illegally, gain legal status, and have a pathway to citizenship immediately.

This also includes the clause of transporting large armies into the nation. Do you really think those millions of unattended illegal minors aren’t going to have their parents come into the country? Do you really think those kids are just small, innocent children? Just like the influx of Somalian refugees during Obama, these are soldiers that could be used by the government against the citizens. Will they be? Only time will tell. One thing is for certain, concerning the surge of illegals into the country, the Democrat Party is hoping that each and every one of them will vote Democrat once they are given citizenship. Then again, with the attack on the electoral system, they could be voting whether a citizen or not.

The Democrat Party has been attacking the Constitution for decades. Whittling away at our rights and freedoms over the years so as not to be noticed. Now, since the power is held by the Democrats in Washington, they are attacking our fundamental rights, the right to free speech, the right to keep and bear arms, the right of due process, at an unprecedented rate, openly and joyously.

Nothing that the Washington Establishment is doing is Constitutional. Nothing they are doing is pro-America. Nothing they are doing is pro-rights, freedom, and liberty. They are turning our Constitutional Republic into a Socialist State. Centralized, all-powerful, all-controlling bloated federal government. This is what the Founders, the Patriots, fought against in 1776. This is what they warned us about in every document written in the early days of our nation. Abraham Lincoln said that America would not be taken over by an outside force but from within. The Japanese wouldn’t attack mainland USA because we had guns behind every blade of grass. The world has looked to the United States for decades for help from money to soldiers. It has been the United States that has saved the world time and again. Now, we are the ones being taken down. Unfortunately, it’s our own politicians that are doing it.

The Declaration of Independence, one of the most important documents in our national history, is as relevant today as it was 245 years ago. We declared our independence from a tyrannical dominion. Now, it’s time to declare our independence from another tyrannical dominion: the Democrat Party.
